Arrest Warrants

"An arrest warrant protects an individual from an unreasonable seizure and may only be issued upon a showing of probable cause to believe a suspect is committing or has committed an offense." (Fed. R. Crim. P. 4(a))

Bench Warrants

"Bench warrants are warrants issued by a judge to bring a nonappearing defendant or witness before the court." (Pen. Code Sections 978.5-981, for defendants); (CCP Section 1993, for witnesses).

If a defendant has been ordered to appear, or has promised to appear, and counsel has not been authorized to appear on his or her behalf under Penal Code Section 977, the court may issue a bench warrant. (Penal Code Sections 978.5-980, 985-986.)
