The Contractors State License Board (CSLB) was established to help raise construction standards throughout the State of California and protect consumers. For those who operate without a license provided by the State of California may find themselves subject of an investigation. The Statewide Investigative Fraud Team (SWIFT) conducts investigations, including undercover operations and construction sweeps, to determine if laws and regulations are being followed.

If someone is caught contracting without a license, criminal charges may be filed. The charges can range from a misdemeanor to a felony. Misdemeanor charges can carry up to six months in county jail, plus a court fine, and an administrative fine. The consequences become more severe if the contracting without a license continues, which may include mandatory jail and a percent of the contract price.

Felony charges may be filed when someone illegally uses another person’s contractor’s license. Felony charges may also be filed when someone attempts to mislead consumers into believing that they are a licensed contractor. If someone contracts for work in a state or federal natural disaster area, who does not have a license, felony charges may also be filed. The consequences for a felony conviction could include prison.

Anyone who has hired a person to complete work that is not a state licensed contractor is not required to pay for the work done. Moreover, they cannot be sued for non-payment. Licensed contractors can work with the CSLB to resolve disputes or disagreements through mediation, negotiation, or arbitration.
