Penalties for Ecstasy Possession

According to CA Health & Safety Code 11377, personal possession of ecstasy is a wobbler offense, meaning it may be charged as a felony or a misdemeanor depending on your prior history and the amount of the drug found.

  • Misdemeanor charge: a year in prison and up to $1,000 in fines
  • Felony charge: 16 months-3 years in prison and up to $10,000 in fines

Penalties for Intent to Sell

According to CA Health and Safety Code 11378, intending to sell ecstasy is a felony charge, punishable by up to three years in prison and a maximum of $10,000 in fines. Prosecutors may elevate a possession charge for ecstasy to intent to sell if you are found with a large amount of the drug, or it is packaged for sale.

Penalties for Transportation & Sale

CA Health and Safety Code 11379 states that selling or transporting ecstasy is a felony offense, punishable by up to 4 years in prison and fines of $10,000. If you were transporting it over more than 2 county lines, then the jail time may be elevated to 9 years.
