California recently added Health and Safety Code Section 11395, which creates a felony for people who are charged with possession of drugs and who also have two or more prior drug convictions. Previously, simple possession of drugs was always a misdemeanor. Now, the San Diego District Attorney can charge the third possession case as a felony. A felony conviction may lead to prison and other serious consequences.
Previous drug convictions can be misdemeanors or felonies. Under HS 11395, previous convictions or “priors” include Health and Safety Code Sections: 11350, 11351, 11351.5, 11352, 11353, 11353.5, 11353.7, 11370.1, 11377, 11378, 11378.5, 11379, 11379.5, 11379.6, 11380, or 11395.
